Terms of use.

These terms of use ("Terms") govern the use of the Soulsync Service. Together with the Privacy Policy, they form the entire agreement between the User and Boost Studio SAS. Any registration to the Service constitutes full, complete and unreserved acceptance of their provisions.

Preamble

Soulsync is a mobile dating app designed to foster chosen, deep and lasting relationships. The Service is aimed at adults who wish to meet someone with intention, away from the logic of endless scroll, instant gratification or targeted advertising.

These Terms comply with the Civil Code, the Consumer Code, the Intellectual Property Code, European Regulation 2016/679 (GDPR), Law No. 2004-575 of 21 June 2004 (LCEN), European Regulation 2022/2065 on digital services (DSA), as well as all applicable regulations.

Definitions

In these Terms, the terms designated below with a capital letter shall have the following meaning:

Service
The Soulsync mobile app, the soulsync.app website, and all dependent features (Cupidon, Connexion Day, the eleven-step journey, journal, conversations).
Publisher
Boost Studio SAS, a simplified joint-stock company with capital of €100, registered with the Marseille Trade and Companies Register under number 914 016 837, which publishes and operates the Soulsync brand.
User
Any adult natural person who creates an account on the Service and accepts these Terms.
Connexion Day
A daily selection of four algorithmically chosen profiles presented to the User, extended to twelve profiles for Soulsync+ subscribers.
Cupidon
A proprietary conversational assistant, based on language models, that accompanies the User throughout the journey.
Journey
A sequence of eleven steps that the User and their contact go through together before any physical date.
Subscription
The paid Soulsync+ subscription, giving access to extended features, under the conditions of Article 12.

Purpose

These Terms set out the conditions under which the Publisher makes the Service available to the User, as well as the respective rights and obligations of the parties.

The Service is made available free of charge in its basic version. Certain extended features are accessible through a Soulsync+ Subscription, under the conditions of Article 12.

Acceptance

Registration to the Service is subject to full, express and unreserved acceptance of these Terms and the Privacy Policy. The User expresses acceptance via a checkbox at registration, under the conditions of Article 1127-1 of the Civil Code.

The User declares having read these Terms beforehand and acknowledges having the legal capacity required to subscribe to the Service.

Access to the Service

The Service is strictly reserved for natural persons aged at least 18 years. An age-verification mechanism is implemented at registration. Any account created in breach of this condition will be deleted without notice or compensation.

Access to the Service requires an Internet connection and a compatible device (iOS 15+, Android 9+). Connection costs are borne solely by the User.

The Publisher strives to keep the Service accessible 24/7, without being able to guarantee permanent availability, particularly in the event of maintenance, updates or force majeure events.

User account

The User undertakes to provide accurate, truthful and up-to-date information, and to keep it as such throughout their use of the Service. They guarantee that the photographs published represent them personally and that they hold the rights necessary for their publication.

The User may not create more than one active account. They are solely responsible for the confidentiality of their credentials and undertake to immediately notify the Publisher of any unauthorized use at security@get-soulsync.com.

Identity theft is punishable under Article 226-4-1 of the Criminal Code by one year's imprisonment and a fine of €15,000.

Description of the Service

Connexion Day. Each day, the User is offered a selection of four profiles (twelve profiles for Soulsync+ subscribers), chosen by our proprietary algorithm based on compatibility of values, life rhythms and declared intentions. These profiles remain accessible throughout the day and are renewed each day at 07:00 (Paris time).

Cupidon. At registration, the User engages in a five-question dialogue with Cupidon, our proprietary conversational assistant. Cupidon then presents the Connexion Day profile selection each day. Cupidon does not intervene in private exchanges between Users: those conversations remain strictly between the parties concerned.

Eleven-step journey. Between the match and any physical date, the User and their contact go through eleven structured steps together (blind question, values game, photo challenge, aspirations, shared challenge, contradictions, voice note, affinity map, pact). These steps are an essential and distinctive feature of the Service.

Personal journal. The Service offers a private introspection space, accessible exclusively to the User, with a daily aura, writing prompts and a continuity tracker (streak).

Rules of conduct

The User undertakes to behave respectfully at all times toward other Users, moderators and the Publisher. In particular, they undertake to:

  • Communicate sincerely and kindly, with no intent to deceive, manipulate or harm.
  • Respect everyone's sensitivity, orientation, beliefs and pace.
  • End an exchange or decline a meeting without justification, and accept that another User may do the same.
  • Report any behavior that contravenes these Terms or the law.

Prohibited behavior

The following are expressly prohibited within the Service, on pain of sanctions up to permanent account deletion and reporting to the competent authorities:

  • Any discriminatory remarks based on origin, sex, gender identity, sexual orientation, religion, disability or any other protected criterion.
  • Harassment (Article 222-33-2-2 of the Criminal Code), threats, psychological pressure, sexual exhibition (Article 222-32) or the non-consensual sharing of intimate images (Article 226-2-1).
  • Commercial solicitation, the promotion of third-party services, canvassing, sending advertising content.
  • The sharing of child-pornographic, terrorist content, content glorifying crimes against humanity or undermining human dignity.
  • Any attempt to technically circumvent the Service (scraping, reverse engineering, unauthorized automation).
  • Identity theft, the creation of fake profiles, the use of photographs belonging to a third party.
  • Requesting, promising or exchanging financial consideration in connection with a meeting.

Moderation and reporting

In accordance with European Regulation 2022/2065 (Digital Services Act), the Service provides each User with reporting tools accessible directly from each profile and each conversation.

Each report is examined within 48 business hours by our moderation team. The reported User is informed of the action taken and may, where applicable, file an internal appeal at appel@get-soulsync.com.

The Publisher keeps, for at most one year, the elements necessary to prevent repeat offenses and cooperates with judicial authorities in the event of a criminal offense, under the conditions of Article 6-II of the LCEN.

Intellectual property

All elements making up the Service remain the exclusive property of the Publisher or its rights holders (Articles L. 111-1 et seq. of the Intellectual Property Code).

Content published by the User (photographs, texts, voice notes) remains their property. The User grants the Publisher a non-exclusive, free, worldwide license, for the duration strictly necessary to operate the Service, solely for the purposes of operating, displaying and saving such content for their contact. No other use may be made of it.

Soulsync+ subscription

The Soulsync+ subscription is offered at €9.99 incl. VAT per month or €59.99 incl. VAT per year (equivalent to €5.00 per month), payable within the app via Apple App Store, Google Play billing systems or, alternatively, by bank card via our provider Stripe Payments Europe Ltd.

The subscription is concluded for an indefinite term with tacit renewal at each due date, in accordance with Articles L. 215-1 et seq. of the Consumer Code. It can be cancelled at any time from the account settings, free of charge and without notice. Cancellation takes effect at the end of the current period, with no pro-rata refund except in cases of force majeure.

  • Twelve profiles a day instead of four.
  • Unlimited exchanges with Cupidon.
  • Access to personalized weekly insights.
  • Advanced journal tools (themed prompts, archive).

Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the Consumer Code, the consumer User has a period of fourteen (14) days from subscription to exercise their right of withdrawal, without having to give a reason or bear a penalty.

However, in accordance with Article L. 221-28 1° of the same Code, by starting to use the Service immediately after subscribing, the User expressly acknowledges waiving their right of withdrawal for the part of the Service already consumed. A pro-rata refund remains possible upon written request to support@get-soulsync.com.

Note

A standard withdrawal form is provided on simple request to support@get-soulsync.com, in accordance with Article R. 221-1 of the Consumer Code.

Liability

The Publisher is subject to a best-efforts obligation regarding the availability and proper functioning of the Service. Its liability cannot be engaged for:

  • Content published by Users themselves (Article 6-I-2 of the LCEN).
  • Interactions between Users, and in particular the consequences of any physical date freely organized between them.
  • An interruption of the Service due to an external cause or relating to an overriding interest (maintenance, security update).
  • Indirect damage, it being understood that the Publisher's liability is in any event limited to direct and foreseeable damage, up to the amounts actually paid by the User over the last twelve months.

No provision herein may, however, exclude or limit the Publisher's liability in the event of gross negligence, willful misconduct or bodily injury.

Force majeure

Neither party can be held responsible for the non-performance of its obligations in the event of a force majeure event within the meaning of Article 1218 of the Civil Code. The prevented party will inform the other as soon as possible and the parties will seek in good faith to adapt their commitments.

Personal data

The processing of the User's personal data is entirely governed by the Privacy Policy, an integral part of these Terms.

Changes to the Terms

The Publisher reserves the right to modify these Terms to adapt them to changes in the Service, the legal or regulatory framework. Any substantial change will be notified to the User by email and in-app message at least thirty (30) days before it takes effect. During this period, the User may cancel their account free of charge.

Suspension and termination

The User may delete their account at any time from the app settings. This deletion entails the permanent erasure of all associated data within thirty (30) days, subject to mandatory legal retention.

The Publisher reserves the right to unilaterally suspend or terminate any User's account in the event of a serious or repeated breach of these Terms, after an electronic formal notice has remained unanswered for eight (8) days, except in cases of urgency or particular seriousness justifying an immediate measure.

Mediation and disputes

In accordance with Articles L. 611-1 et seq. of the Consumer Code, the consumer User has, in the event of a dispute not resolved amicably, the right to use free of charge the Centre de Médiation et d'Arbitrage de Paris (CMAP), 39 avenue Franklin D. Roosevelt, 75008 Paris, www.cmap.fr.

Referral to the mediator must be preceded by a written complaint to the Publisher that has remained unanswered for two months.

Applicable law

These Terms are governed by French law.

Failing an amicable resolution, any dispute relating to their interpretation, performance or termination shall fall within the jurisdiction of the courts within the jurisdiction of the Court of Appeal of Aix-en-Provence, subject to the mandatory consumer-protection provisions, in particular those of Article R. 631-3 of the Consumer Code.
